As long as data is collected, stored and processed, this will be done on the basis of the European General Data Protection Regulation (GDPR), the German Data Protection Act (BDSG), the German Telemedia Act (TMG) as well as other legal provisions.

The following privacy policy describes how personal data is collected, stored and processed in connection with the use of the website www.visitessen.de and the measures taken to protect this personal data.

General information on data processing

Scope of processing of personal data
Personal data is basically only collected in as far as this is required for the provision of a functional website as well as the use of its contents and services. Personal data is processed with the consent of the users. An exception occurs in cases where the processing of the data is authorised by legal provisions.

The transmission of data on www.visitessen.de always takes place in an SSL-encrypted manner.

Legal basis for the processing of personal data
Provided that the consent of the data subject for data processing procedures is obtained, Article 6 (1), point (a) of the EU General Data Protection Regulation (GDPR) shall serve as the legal basis. As for the processing of personal data which is required for the performance of a service, Article 6 (1), point (b) of the EU General Data Protection Regulation (GDPR) shall serve as the legal basis. This also applies to data processing required for the implementation of pre-contractual measures.

Provided that processing of personal data is required for the fulfilment of a legal obligation, Article 6 (1), point (c) of the GDPR shall serve as the legal basis. In the event that vital interests of the data subject or of any other natural person necessitate the processing of personal data, Article 6 (1), point (d) of the GDPR shall serve as the legal basis. If the processing is required for the performance of a task that is in public interest or for exercising public authority vested on the Controller, Article 6 (1), point (e) of the GDPR shall serve as the legal basis.

Deletion of data and storage duration
Personal data of the data subject is deleted or blocked as soon as the purpose for its storage ceases to exist. Furthermore storage can take place if this was planned for by the European or national legislator in the EU legal regulations, laws or other provisions to which the Controller is subject. Blockage or deletion of the data will also take place, if the storage deadline stipulated by the said norms expires, unless there is further need for storage of the data for purposes of contract conclusion or fulfilment.

Provision of the website and creation of log files

Description, scope and duration of data processing
Whenever the website of EMG - Marketing GmbH is accessed, the system automatically collects data and information of the accessing computer. In this process, IP-addresses that are clearly identifiable with the accessing computer are also stored, held for security reasons and deleted in the course of time.

Legal basis for the processing of data
The legal basis for the temporary storage of the data and the log files is Article 6 (1) point (e) of the GDPR.

Purpose of the data processing
The storage in log files is carried out in order to guarantee the functionality of the website. In addition, the data serves the purpose of optimising the information content and securing our information technology system. Evaluation of the data for marketing purposes does not take place in this connection.

Possibility of objection and of data removal
The collection of data for the provision of the website and the storage of the data in log files is imperative for the operation of the website. There is therefore no possibility of objection on the part of the users.

Use of Cookies

Description and scope of the data processing
This website uses so-called Cookies in order to organise the information content of the website in a more user friendly way. Some elements of the website require that the browser used to access our website be identified even after changing to another web page. The user data collected by technically necessary Cookies is not used for creating user profiles.

Legal basis for the processing of data
The legal basis for the processing of personal data by using Cookies is Article 6 (1) point (e) of the GDPR.

Duration of the storage, possibility of objection and removal
Users have full control over the use of Cookies. By adjusting the settings in the Internet browser being used, the transmission of Cookies can be deactivated or restricted. Already stored Cookies can be deleted any time. This can also be done automatically. If Cookies installed for the use of the EMG - Marketing GmbH website are deactivated, it is possible that not all functions of the website will continue to be provided in full.

Description and scope of the data processing
EMG - Essen Marketing GmbH has provided a number of online forms on its website, which can be used to contact us electronically or for the provision of services. As part of this usage, data submitted through the input mask is transmitted to EMG - Essen Marketing GmbH and stored there.

The online forms provided are equipped with a type of transport encryption (SSL-encryption). In this way, data is transmitted more securely. For the processing of the data, consent is sought within the context of the dispatch process, and reference is made to this privacy policy.

Newsletter

Description and scope of the data processing
There is an option of subscribing to the free newsletter of EMG – Essen Marketing GmbH on our website. In the process of subscribing to the newsletter, the data submitted through the input mask is transmitted to us. The e-mail address as well as the name of the user is stored for this purpose. Submission of any further contact data is optional or in certain isolated cases imperative for further processing. A relevant note in this respect can be viewed at the time of registration.

There will be no sharing of data with third parties in connection with the data processing for purposes of sending out newsletters. The data is used exclusively for the dispatch of the newsletter.

The subscription to the newsletter can be discontinued by the data subject any time. There is a corresponding note in every newsletter for this purpose (Cancel newsletter).

Use of social Plugins

Social plugins from various social networks on the Internet (e.g. Facebook, Twitter, Google+, Instagram) are integrated into our website. These enable you to set bookmarks on the site and to share these bookmarks with other participants in the social network. You can recognise social Plugins by the logos that can be seen on the websites of social networks. These enable you to set bookmarks on the site and to share these bookmarks with other participants in the social network. We offer you a ‘two clicks’ solution to use this facility: when the site loads, buttons are displayed to you but they are deactivated: there is no communication with Facebook, Google+ or Twitter. Use of YouTube

Use of maps from Google Maps

www.visitessen.de uses Google Maps for the presentation of interactive maps and the drafting of route descriptions. Google Maps is a map service of Google Inc., 1600 Amphitheatre Parkway, Mountain is view, California 94043, USA. By using Google Maps, information about the use of this website, including your IP-address and the (start-) address entered in the context of the route planner function, can be transmitted to Google. The contents of the maps are transmitted by Google directly to your browser and integrated into the website by the browser. EMG - Essen Marketing GmbH does not have influence on the scope of the data collected by Google in this way.

Statistical surveys

Every time you access www.visitessen.de, particular data is stored permanently in anonymised form using the statistics software "Matomo" (https://matomo.org/). A so-called “Cookie” is stored on your computer by Piwik for this purpose. This “Cookie” is stored for seven days, allowing us to collect the following data:

  • Name of file requested,
  • Date and time of the request,
  • Amount of data transmitted,
  • Indication whether download was successful,
  • Parts of the IP address of the requested Internet access (the first two octets, i.e. the provider is recognisable, but not the individual computer).
  • Version of the browser and operating system

  • Plugins (Flash, PDF, and similar)
  • Origin of links to measure the success of services such as social networks (e.g. Facebook or Twitter) or search terms in search engines (e.g. Google)

Collection of personal data in the meaning of the GDPR does not take place.

Right to information

Data protective rights are regulated in chapter 3 (Article 12 pp.) of the GDPR. According to these legal regulations, users have a right to receive information about their stored personal data, about the purposes of the processing, about possible transmission to other places, as well as the duration of the storage. To exercise the right to information, statements or copies can be provided.

Right to rectification of data
According to Article 16 of the GDPR, users have the right to demand correction of incorrect personal data concerning them.

Right to deletion of data
In fulfilment of the special characteristics of Article 17 (1) points (a – f) of the GDPR, users have the right to have their personal data deleted.

Right to restriction of data processing
In fulfilment of the special characteristics of the Article 18 (1) points (a – d) of the GDPR, users have the right to demand restriction of processing their personal data.

Right to data portability
According to Article 20 of the GDPR, users have the right to receive their personal data in a structured, standard and machine-readable format. Furthermore, the personal data of users can be transferred to another Controller, provided that the data was collected according to Article 6 (1) point (a) of the GDPR and the further processing is to be done electronically.

Right of objection
Users have the right according to Article 21 of the GDPR, for reasons arising out of their particular situation, to raise objection any time against the processing of their personal data collected according to Article 6 (1) point (e). Processing of the personal data is then only carried out if there are compelling legitimate grounds for the processing which override the interests, rights and freedoms of the users or if the processing is for purposes of asserting, exercising or defending legal claims.
